Terms of Service

These Terms of Service (“Terms”) govern your use of the UtiliteeWare™ platform provided by Beelen Energy Services. Please read them carefully.

1. Acceptance of Terms

By using UtiliteeWare you agree to these Terms. If you do not agree, do not use the platform.

2. Description of Service

• UtiliteeWare is a commercial real estate energy management platform.
• Features include utility bill management, performance tracking, carbon emissions reporting, capital planning, and Peak Tracker.

3. Account Responsibilities

• You are responsible for maintaining the security of your account.
• You must provide accurate property and utility information.
• One account per authorized user.

4. Green Button Authorization

• By connecting a utility provider via Green Button, you authorize Beelen Energy Services to collect your utility data (electricity, natural gas, or water) from that provider on your behalf. Supported providers include Toronto Hydro and Enbridge Gas.
• You may revoke this authorization at any time through your utility provider's account portal or by contacting us.
• We will only use the data for energy management purposes within UtiliteeWare.

5. Acceptable Use

• You may not use UtiliteeWare for unlawful purposes.
• You may not attempt to access other users' data.
• You may not reverse engineer the platform.

6. Data and Privacy

• Our use of your data is governed by our Privacy Policy.
• Utility data collected via Green Button remains your property.

7. Service Availability

• We aim for high availability but do not guarantee uninterrupted service.
• We may perform maintenance with reasonable notice.

8. Limitation of Liability

• UtiliteeWare is provided as-is for informational purposes.
• Energy savings projections and carbon calculations are estimates only.
• Beelen Energy Services is not liable for decisions made based on platform data.

9. Termination

• Either party may terminate the service agreement with 30 days notice.
• Upon termination, you may request export of your data.

10. Governing Law

These Terms are governed by the laws of Ontario, Canada.
